Participant Waiver, Release of Liability, Assumption of Risk & Media Consent

Acknowledgment of Participation

I voluntarily choose to participate in a cocktail class, tasting, demonstration, workshop, event, or related activity ("Activities") hosted or organized by Bar Theory LLC ("Company") at Babylon, Dalila's, or another designated venue (collectively, the "Venues").

I understand that participation may involve the preparation, handling, tasting, and consumption of alcoholic beverages and other food or beverage products.

Assumption of Risk

I understand and acknowledge that participation in the Activities involves inherent risks, including but not limited to:

• Consumption of alcoholic beverages

• Intoxication or impairment

• Allergic reactions to ingredients

• Accidental cuts, burns, slips, falls, or other injuries

• Property damage

• Illness resulting from food or beverage ingredients

• Injuries occurring during transportation to or from the event

I voluntarily and knowingly assume the risks associated with my participation in the Activities.

Alcohol Responsibility Agreement

By accepting this Agreement, I certify that:

• I am at least twenty-one (21) years of age.

• I possess a valid government-issued photo ID and will present it upon request.

• I am not participating while knowingly impaired by alcohol, drugs, or any substance that could affect my judgment.

• I will consume alcohol responsibly.

• I will not operate a motor vehicle while impaired.

• I understand that Bar Theory LLC, Babylon, and Dalila's reserve the right to refuse service, limit alcohol consumption, or remove any participant whose behavior is unsafe, disruptive, or unlawful.

Medical Conditions & Allergies

I understand that ingredients used during the Activities may include:

• Citrus

• Dairy

• Nuts

• Herbs

• Spices

• Eggs

• Other common allergens

I acknowledge that it is my responsibility to disclose any allergies, sensitivities, dietary restrictions, or relevant medical conditions before participating.

I voluntarily assume the risks associated with any undisclosed condition or allergy.

Release of Liability

To the fullest extent permitted by South Carolina law, I hereby release, waive, discharge, and hold harmless:

Bar Theory LLC, Babylon, Dalila's, and their respective owners, operators, managers, instructors, contractors, employees, volunteers, venue partners, landlords, agents, and representatives (collectively, the "Released Parties")

from claims, demands, damages, losses, liabilities, costs, expenses, injuries, or causes of action arising out of or relating to my participation in the Activities, including personal injury, illness, property damage, or economic loss.

This release is intended to include claims arising from the ordinary negligence of any Released Party, to the extent such claims may lawfully be released under South Carolina law.

This release applies to claims arising before, during, or after the Activities, to the extent connected with my participation.

Nothing in this Agreement is intended to waive rights or claims that cannot lawfully be waived.

Indemnification

To the fullest extent permitted by law, I agree to indemnify and hold harmless Bar Theory LLC, Babylon, Dalila's, and their respective owners, operators, employees, and representatives from third-party claims, damages, costs, or expenses arising from:

• My negligent, reckless, or intentional actions during the Activities

• Damage or injury caused by my conduct to other persons or property

• My violation of applicable laws or venue rules

This provision does not require me to indemnify a Released Party for that party's own negligence or misconduct.

Photography & Media Consent

I understand that photographs, videos, and recordings may be taken during the Activities.

I authorize Bar Theory LLC to use my likeness, image, voice, and appearance in photographs, videos, promotional materials, social media, advertising, websites, and other marketing materials without compensation, if I separately provide my consent.

I understand that media consent is optional and that declining consent will not prevent me from participating in the Activities.

Severability

If any portion of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect to the extent permitted by law.

Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the State of South Carolina.

Acknowledgment & Agreement

I acknowledge that:

• I have carefully read and understand this Agreement.

• I understand the inherent risks associated with participating in cocktail workshops and activities involving alcoholic beverages.

• I understand that this Agreement may limit my right to pursue certain legal claims against Bar Theory LLC, Babylon, Dalila's, and the other Released Parties.

• I voluntarily accept the terms of this Agreement and assume the risks described herein.

• I understand that my electronic signature constitutes my agreement to these terms.
